1. User's Acknowledgment and Acceptance of Terms

Lekker Jobs (Pty) Ltd (thereafter also referred to as "we") provide a platform for effective matching of temporary work assignments and available workforce using the site LekkerJobs.co.za (thereafter also referred to as "our website" or "this website") to you, the user, subject to your compliance with all these Terms of Use including the Privacy Policy therein. In addition, when using particular services or materials on this site, users shall be subject to any posted rules applicable to such services or materials that may contain terms and conditions in addition to those in these Terms of Use.

By using www.LekkerJobs.co.za, you hereby agree to the terms of use as laid out below. If you do not wish to be bound by these terms of use, please exit this site now. Your agreement with Lekker Jobs (Pty) Ltd regarding compliance with these terms of use becomes effective immediately upon commencement of your use of this site.

These Terms of Use are effective as of 1 January 2013.  We may modify these Terms of Use periodically without previous notice to you, and such modifications shall be effective immediately upon publishing such modifications to this website. It is the user's responsibility to review the Terms of Use on a regular basis to ensure that you are fully aware of the terms and conditions to which you are bound. The Terms of Use is a legally binding document and, by your continued use of the website, you agree to be bound by these terms and conditions.

As used in these Terms of Use, references to our Affiliates include our owners, our officers, directors, suppliers, partners, sponsors, and advertisers and includes all parties involved in creating, producing, and/or delivering this site and/or its contents. 

2. Description of Services

Our services are focused on providing a platform for recruitment for temporary work assignments to university, technicon and college students as well as non-students available for temporary or project work (thereafter "job seekers") and individuals, families, companies and organizations (thereafter "recruiters" or "employers").  

We make our services available on this website including, but not limited to, free registration as a job seeker or recruiter, free filtering through job seekers and advertisements, free job advertising for recruiters, free use of matching of temporary job requirements to the job seekers based on their location, experience and other selected criteria, payment by recruiters for selected suitable candidate personal and contact details, rating and reviews of jobseekers’ performance and viewing these performance ratings and reviews, free promotion of graduate programs and internships.

Lekker Jobs (Pty) Ltd and/or its Affiliates do not verify or confirm any of and all the information supplied by any and all job seekers and or any and all recruiters and or any other parties utilizing and or portrayed on our website and cannot warrant the accuracy, reliability or usefulness of any and all information, and data and all users of this website acknowledge and warrant that Lekker Jobs (Pty) Ltd and/or its Affiliates have no liability whatsoever in whatever way, form and usage of the website and its contents.

Lekker Jobs (Pty) Ltd and/or its Affiliates under no circumstances become job seekers’ employers nor fall into the category of labour brokers and bare no responsibility or liability for the delivery, timeliness, quality or any other attributes of the temporary assignment for which job seekers were recruited.

Lekker Jobs (Pty) Ltd and/or its Affiliates bare no responsibility or liability for conditions stipulated by the recruiter on this website, payments to the job seeker or any other attributes of the contractual relationship between the job seeker and the recruiter, whether oral or in writing, resulting from the use of this website.

All users of this website, whether registered users or not, agree to use the website at their own risk and agree to hold Lekker Jobs (Pty) Ltd and/or its Affiliates totally harmless.

3. Registration Data, Privacy and password security

In order to access some of the services on this site, you will be required to use an account and password that can be obtained by completing our online registration form, which requests certain information and data, and maintaining and updating your Registration Data as required. By registering, you agree that all information provided in the Registration Data is true and accurate and that you will maintain and update this information as required in order to keep it current, complete, and accurate. In its sole discretion the website owners and managers shall have the right to delete any or all information that is proved to these parties to be false, misleading, inaccurate and or fraudulent and by so doing these parties intend to ensure the integrity of the information on the website.

You also grant us the right to disclose to third parties certain Registration Data about you and to use this data to send you targeted emails advertising jobs.The information we obtain through your use of this site, including your Registration Data, is subject to our Privacy Policy, which is specifically incorporated into these Terms of Use.

You are entirely responsible for maintaining the confidentiality of information regarding access to your account. Therefore, you must take steps to ensure that others do not gain access to your password and account.

4. Privacy Policy

Lekker Jobs (Pty) Ltd shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Lekker Jobs (Pty) Ltd and its Affiliates learn certain information about you during your visit when accessing this website.

If you visit our site but do not register as a user we collect and store only the following information about you:

§  The name of the domain from which you access the Internet.

§  The date and time you access our site.

§  The Internet address of the website you used to link directly to our site.

If you register as a job seeker seeking a once-off or temporary employment or as an individual, company or institution seeking candidates for such employment, we will collect and retain the following information:

§  Recruiters’ and jobseekers’ user names and passwords;

§  Job seekers’ personal and career related information;

§  Job seekers’ history of assignment offers accepted and declined;

§  Job seekers’ performance ratings provided by recruiters;

§  Recruiters’ personal or business identification information;

§  Recruiters’ staff requirement details;

§  Recruiters’ advertisements posted on our website;

§  Recruiters’ previous proposals declined and accepted;

§  Recruiters’ payment history regarding our services;

§  Other information necessary to facilitate effective matching of jobseekers’ and employers’ requirements. 

Job seekers’ personal details including their performance ratings but excluding their contact details will be provided to the users of this website.  Job seekers’ contact details will only be released to the recruiter after the payment for the connection fee has been received. 

We will use your email address to contact you about matters directly related to our website and jobs offers, such as sending you a reminder to update your profile, accept/decline temporary job offers, to make selection of suitable candidates or information about changes on our website that may affect you. We will not sell your personal information to third parties for their marketing purposes without your explicit consent. You will be able to remove any of your personal information stored in our systems at any time, by using the on-line forms on our website.

Although you may remove your personal information from our searchable database at any time, recruiters who have had access to the database may have retained a copy of this information in their own files or databases. We are not responsible for the retention, use, or privacy of your personal information by recruiters in these instances.

We compile non-personal statistical information about browsing habits, click-patterns, and access to our website.  We may use and share any information that does not relate to any specific individual. We own and retain all rights to non-personal statistical information collected and compiled through our website.

Lekker Jobs (Pty) Ltd or our service providers may use "cookies" (small files placed on your hard drive) on certain of our pages to help analyze our web page flow; customize our services, content and advertising; measure promotional effectiveness, and promote trust and safety. We may use cookies to help identify you and maintain your signed-in status. You are always free to decline cookies if your browser permits, although doing so may interfere with your use of some of our sites or services.

This site is not intended for children under 16 years of age. We do not knowingly collect any information from children under the age of 16.

5. Conduct on Site

Your conduct on this website is subject to laws and regulations, and you are solely responsible for the content of your communications through this site.  By accepting these Terms of Use you agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content:

§  that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;

§  that includes personal or identifying information about another person without that person's explicit consent;

§  that is copyrighted or patented, protected by trade secret or trademark, or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission or a license from their rightful owner to post the material;

§  that infringes any of the intellectual property rights of any party, or is content that you do not have a right to make available under any law or under contractual or fiduciary relationships;

§  that is harmful, abusive, unlawful, threatening, harassing, defamatory, pornographic, libelous, invasive of another's privacy or other rights, or harms or could harm minors in any way;

§  that impersonates any person or entity, including, but not limited to, a Lekker Jobs (Pty) Ltd employee, or falsely states or otherwise misrepresents an affiliation with a person or entity;

§  that constitutes or contains "pyramid schemes," "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," or unsolicited advertisements of a commercial nature;

§  that includes links to commercial services or third party websites, except as specifically allowed by Lekker Jobs (Pty) Ltd;

§  that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of content transmitted through this website.

We neither endorse nor assume any liability for the contents of any material uploaded or submitted by third party users of the site. We generally do not pre-screen, monitor, or edit the content posted by users of communications services, chat rooms, message boards, newsgroups, software libraries, or other interactive services that may be available on or through this site. However, we and our agents have the right at their sole discretion to remove any content that, in our judgment, does not comply with these Terms of Use and any other rules of user conduct for our site, or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing such content. You hereby consent to such removal and waive any claim against us arising out of such removal of content.

In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. Not all areas of the site may be available to you or other authorized users of the site. You shall not interfere with anyone else’s use of this site. Users who violate systems or network security may incur criminal or civil liability.

Users may not harvest the LekkerJobs.co.za content (or any part thereof) through the use of automated retrieval robot, screen scraper or similar technology for the purpose of data mining, data gathering or extraction of information for establishing, maintaining, advancing or reproducing information contained on LekkerJobs.co.za on your own website or in any other publication, except with our prior written consent.

6. Links to Third Party Sites

Any networks that are linked from this website are not under our control, and we do not assume any responsibility or liability for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of those linked networks. All links are provided for your convenience only; they do not represent an endorsement or referral by us and you access linked networks at your own risk.

7. Unauthorized Use of Materials

Subject to our Privacy Policy, any communication or material that you transmit to this site or to us, whether by electronic mail, post, or other means, for any reason, will be treated as non-confidential and non-proprietary. If you or any user of this site believes its copyright, trademark or other property rights have been infringed by a posting on this site, you or the user should send notification to our address as disclosed in our website in section Contacts immediately.

To be effective, the notification must include:

The content of this website cannot be copied, stored, transmitted, reproduced, modified, republished, uploaded or distributed to third parties, except for downloading or reproduction of one copy to be used strictly for personal reasons, without prior written permission from us or the specific content provider, and you are solely responsible for obtaining permission before reusing any copyrighted material that is available on this site.

Neither Lekker Jobs (Pty) Ltd nor its Affiliates warrant or represent that your use of materials displayed on, or obtained through, this site will not infringe the rights of third parties.

9. Terms and Conditions of Sale

Lekker Jobs (Pty) Ltd hereby agrees to sell (through the website LekkerJobs.co.za), and you as a recruiter or other person hereby agree to purchase job seeker’s details, based on your own selection.

The buyer agrees to pay the purchase price for the job seeker’s information according to the pricelist published on this website and the volume of services purchased.

The total amount of the purchase price shall be payable by the recruiter or other person in full prior to releasing the job seeker’s details by Lekker Jobs (Pty) Ltd.  Lekker Jobs (Pty) Ltd release the job seeker’s details within 48 hours of receiving the payment unless such release is not possible due to reasons listed in par. 20 of these Terms of Use.

Unless otherwise agreed in writing, delivery of the job seeker’s information including contact details shall be made to the recruiter or other person via email delivery. The said emails will be sent to the address given by the recruiter upon their registration and/or any updated email address provided on their profile page.

The provision of services by Lekker Jobs (Pty) Ltd is subject to availability.  In cases of unavailability, Lekker Jobs (Pty) Ltd will refund the client in full within 30 days.

Payment may be made via Visa, MasterCard, Diners or American Express credit cards or by bank transfer into the Lekker Jobs (Pty) Ltd bank account, the details of which are provided on the How it works page of this website.

Credit card transactions will be acquired for Lekker Jobs (Pty) Ltd via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa.  PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.  Users may go to www.paygate.co.za to view their security certificate and security policy. 

Customer details will be stored by Lekker Jobs (Pty) Ltd separately from card details which are entered by the client on PayGate’s secure site.  For more detail on PayGate refer to www.paygate.co.za.

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa.  Transaction Currency is South African Rand (ZAR).

Lekker Jobs (Pty) Ltd takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Under no circumstances shall the job seeker display his/her full name and contact details in fields that do not specifically require this information, such as comment fields.  Recruiters shall also not display their name and contact details in any of the job ad fields.  Full names and contact details are only to be filled in during the registration process.  Exchange of contact information is subject to a connection fee, specified by Lekker Jobs (Pty) Ltd on the website. 

10. Disclaimer of Warranties

This website and all information, images, artwork, text, video, audio, pictures and other materials contained on this website, and the website design, content and arrangement (collectively, the "Information") is provided on "AS IS" or "AS AVAILABLE" basis. Lekker Jobs (Pty) Ltd and its Affiliates make no representations or warranties of any kind, express or implied, as to the operation of this website, its services, or the Information.

LEKKER JOBS (PTY) LTD AND ITS AFFILIATES ARE NOT RESPONSIBLE FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES IN ANY WAY ARISING OUT OF YOUR USE OF THIS WEBSITE, ITS SERVICES OR THE INFORMATION, INCLUDING ANY DAMAGES YOU MAY SUFFER AS A RESULT OF YOUR PERSONAL INFORMATION BEING TRANSMITTED BETWEEN YOU AND LEKKER JOBS (PTY) LTD, OR TO OTHER USERS.

LekkerJobs.co.za acts as a platform for job seekers and recruiters to match their temporary employment needs. Lekker Jobs (Pty) Ltd and/or its Affiliates do not represent employment agency or labour brokerage and therefore are not responsible for, nor a party to, any work-related agreements or decisions resulting from your use of this website.

Any disputes in connection with services provided by jobseekers or payments made by recruiters remain between such recruiters and jobseekers. You further acknowledge that Lekker Jobs (Pty) Ltd will not be a party to any such disputes.

Due to the complexity in authenticating users on the Internet, Lekker Jobs (Pty) Ltd and/or its Affiliates are unable to guarantee or verify the authenticity of user identities. In the event that a dispute may arise between users, Lekker Jobs (Pty) Ltd and/or its Affiliates are released from any and all claims, demands and damages of every kind that may arise from our direct or indirect connection with such disputing parties. Users therefore agree that they are solely responsible for the accuracy of any information placed on the website.

12. Indemnification

You will indemnify and hold Lekker Jobs (Pty) Ltd and its Affiliates harmless against any and all actions, costs, damages and reasonable attorney fees arising out of your use of our website and services, your breach of any of these terms and conditions or your infringement of any third party's intellectual property rights.

13. Ratings & Reviews

In order to increase the chances of the high performing job seekers to get offers for temporary assignments and to maximise the benefit of using our services for recruiters, we ask the recruiters to give performance ratings and reviews to the job seekers.  These ratings and reviews are displayed on our website.

The recruiter is under no obligation to provide a rating & review to a job seeker.  The recruiter may only give a rating & review to jobseekers that performed a service for them.  The recruiter is entitled to give an honest feedback, be it positive or negative, and is entitled to write a comment about the quality of the service received, as long as the comments are in accordance with these Terms of Use.  Recruiters have the option to give reviews on job seekers anonymously using their first name or initials, but not using their full name. 

If the jobseeker is not satisfied with the rating & review and believes he/she has been unfairly treated, or the recruiter was not satisfied with the jobseeker’s performance, both parties have the option to contact Lekker Jobs (Pty) Ltd.  We have the option, not responsibility, to contact the recruiter and/or jobseeker to discuss the jobseeker’s performance with them in order to make an informed decision about whether or not to delete the rating and/or review from the jobseeker’s pubic profile and Lekker Jobs (Pty) Ltd have the right to terminate the registration, membership or account with either the jobseeker or recruiter, if we feel that such deletion  will protect other job seekers, other recruiters and the good name of Lekker Jobs (Pty) Ltd.

14. Participation in Promotions

From time to time, this site may include advertisements or promotional information offered by third parties. You may enter into correspondence with or participate in promotions of the advertisers or promoters showing their products on this site. Any such correspondence or promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such correspondence or promotions, are solely between you and the advertiser and or promoter. We assume no liability, obligation or responsibility for any part of any such correspondence or promotion.

15. Prizes

Lekker Jobs (Pty) Ltd may from time to time, at their sole discretion, provide competitions amongst its registered users and may offer prizes as inducements for participation in such competitions.

Lekker Jobs (Pty) Ltd will be the sole and exclusive decision makers and executor of the competitions and the awarding of prizes.

Lekker Jobs (Pty) Ltd reserves the right to publish the identities and the location of the prize winners at its sole discretion and in any way and manner it deems appropriate for its purposes.

Should any registered user not agree to publishing their names and locations then they must not enter the competitions or make it known in writing to Lekker Jobs (Pty) Ltd, P.O. Box 333, West Coast Village, 7733, Cape Town that they do not want to participate in the said competitions.

16. E-mail, Messaging, Blogging, and Chat Services

We may make email, messaging, blogging, or chat services (collectively Communications) available to users of our site, either directly or through a third-party provider.

Each and every job seeker registering on the website and providing their personal information with their specific intent of securing a job offer from a recruiter, or any other person paying for such information of a job seeker hereby acknowledges and authorizes Lekker Jobs (Pty) Ltd to provide such information, being their personal profile with their name and contact details, and or any other information previously uploaded by the job seeker to LekkerJobs.co.za, to the said recruiter or other person in exchange for the payment of monies to Lekker Jobs (Pty) Ltd.

We may employ automated monitoring devices or techniques to protect our users from mass unsolicited communications (also known as spam) and/or other types of electronic communications that we deem inconsistent with our business purposes. However, such devices or techniques are not perfect, and we will not be responsible for any legitimate communication that is blocked, or for any unsolicited communication that is not blocked.

Mailboxes may have a limited storage capacity. If you exceed the maximum permitted storage space, we may employ automated devices that delete or block email messages that exceed the limit. We will not be responsible for such deleted or blocked messages.

17. Termination of Service

You acknowledge and agree that Lekker Jobs (Pty) Ltd reserves the right at any time to modify or discontinue its services and this website with or without notice, and that Lekker Jobs (Pty) Ltd shall not be liable to you or to any third party for any such modification, suspension or discontinuance of the Service.

You acknowledge and agree that Lekker Jobs (Pty) Ltd and/or its Affiliates have no responsibility or liability for the deletion or failure to store any content maintained or transmitted by this website.

You acknowledge and agree that Lekker Jobs (Pty) Ltd, in its sole and absolute discretion, has the right (but not the obligation) to delete or deactivate your account, block your e-mail or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any content, for any reason or no reason at all, including, without limitation, if Lekker Jobs (Pty) Ltd believes that you have violated these Terms of Use. Further, you agree that Lekker Jobs (Pty) Ltd shall not be liable to you or any third-party for any termination of your access to this website. Further, you agree not to attempt to use the Service after any such termination.

18. Governing Law

The use of this site shall be subject to, governed by and construed in all respects with the laws of the Republic of South Africa regardless of the territory from which this website was accessed.

This website is governed by the laws of South Africa and Lekker Jobs (Pty) Ltd chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature

19. Entire Agreement

This agreement constitutes the whole agreement between us relating to the subject matter hereof.  No amendment or consensual cancellation of this agreement or any provision or term thereof shall be binding unless recorded in a written document signed by all relevant parties.

20. General

With the exclusion of utilising the paid for jobseekers’ information in your normal course of business as a recruiter, you agree not to sell, resell, reproduce, duplicate, copy or use for any commercial purposes any portion of this site, or use of or access to this site.
